1. Scope and Two Audiences
This Privacy Policy covers two different groups of people, and the sections below are organized to separate them clearly: visitors to our public marketing site at talentscales.com, and authenticated employee users of the Talent Scales platform whose access comes through their employer. Where a section applies to only one of these groups, it says so explicitly.
2. Categories of Personal Information Collected
Public site visitors
If you visit talentscales.com and submit a form, such as a contact form or a demo request, we collect your name, email address, company name, and any other information you choose to submit.
Authenticated employee users
If you use the Talent Scales platform through your employer, we process job and role data, performance check-in responses, review content, and goal-tracking data, as directed by your employer.
Demographic data is collected and used only for compliance purposes, never for scoring, coaching, or performance decisions. Talent Scales collects limited demographic information (such as date of birth, gender, and race/ethnicity, where provided by your employer). This information is held in a restricted, access-controlled layer of the platform, visible only to your employer's HR compliance personnel. It is never used as an input to your performance score, never surfaced to your manager, and never processed by any AI-assisted feature. Its sole purpose is to support your employer's legal obligation to monitor for and prevent adverse impact in employment decisions.
3. Sources of Information
We receive information directly from you (for example, when you complete a monthly check-in), from your employer (for example, through a census or HRIS import at onboarding), and from the platform itself (usage data generated as you interact with the service).
4. Purposes of Use
We use this information to operate the service, generate performance intelligence for your employer, improve the platform, and conduct aggregate, de-identified research described further below.
5. AI and Aggregate Data Disclosure
Talent Scales may use de-identified, aggregated data derived from platform use for research and benchmarking purposes. This section is under active legal review and will be updated with full detail before this policy converts from interim to permanent status.
6. Our Role Under California Privacy Law
With respect to employee personal information, Talent Scales acts as a service provider to your employer under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (CPRA). Your employer is the "business" under this law and holds the direct obligation to provide notice to its own employees at the point of collection. Talent Scales processes employee personal information according to your employer's instructions, under the terms of the Data Processing Agreement between Talent Scales and your employer.
7. No Sale or Sharing of Personal Information
Talent Scales does not sell personal information. Talent Scales does not share personal information with third parties for cross-context behavioral advertising. This is an affirmative statement about how we operate, not merely an opt-out you need to exercise.
8. Data Retention
We retain personal information for as long as necessary to provide the service to your employer, and as required to meet legal and contractual obligations. Retention periods and criteria vary by data category and are addressed in more detail in the Data Processing Agreement between Talent Scales and your employer.
9. Data Security
Talent Scales uses industry-standard security measures, including row-level data isolation between client companies (so that one company's data is never visible to another) and encryption of data in transit and at rest. We do not publicly disclose the specific technical implementation of our security controls.
10. Breach Notification
If a data breach affecting your personal information occurs, we will notify affected individuals and, where required, regulators in accordance with applicable law. This section is under active legal review and will be updated with our specific notification timeline before this policy converts from interim to permanent status.
11. Your Rights and How to Exercise Them
If you are a public site visitor
Under California law, you generally have the right to know what personal information we collect about you, to request deletion of that information, to correct inaccurate information, and to opt out of the sale or sharing of your personal information. Because Talent Scales does not sell or share personal information, this last right does not currently apply to any activity we engage in, but we disclose it here as required.
If you are an authenticated employee user
Your rights regarding your performance and employment data generally route through your employer, since your employer is the business responsible for that data under California law. If you have questions about your data, we recommend starting with your employer's HR team. We will also work directly with you where required by law.
12. Cookies and Tracking
talentscales.com uses cookies to operate the site and understand how visitors use it. You will be asked to consent to non-essential cookies through a cookie banner when you first visit the site.
13. Children's Privacy
Talent Scales is not directed at, and is not knowingly used by, anyone under the age of 18.
14. International Data
Talent Scales currently serves mid-market clients based in the United States. We are not currently processing data subject to the EU General Data Protection Regulation (GDPR). GDPR readiness is a future-state item we are tracking, not an active practice today.
15. Changes to This Policy
We may update this policy from time to time. A material change will prompt re-acceptance the next time you log in, following the same process described in our Terms of Service. The version number and effective date at the top of this page always reflect the current version.
